I live in a condominium community. Recently we had water in our basement. When we notified our Association we were told that it is our responsibility to remedy the problem. When talking to a friend of mine he made me aware of The Mass Building Code that states that it is owners responsibility to maintain dry basements for their residents. In our case the Association. Can you tell me if you ever heard of this Law and where can I find it in writing? Any help you can give would be greatly appreciated. Thanks

I am not a lawyer nor would I want to be. However in my experience in twenty years of dealing with various condo associations - each association is different. Most Condos will say that common walkways and common storage areas are the responsiblity of the association while the individual condos basement is the responsiblity of the condo owner.

I have seen some condos reimburse some condo owners a flat amount, while other condo associations pay for the whole job. I haven't heard of a law regarding such but would be interested if anyone else knows the details of this condo law. Perhaps a lawyer versed in condo law could give you a basic answer.
